These terms and conditions shall apply to the use of this site and your contract with Stacey Whale for any purchases made online, instore or via email from Stacey Whale a subsidary of Whale & Sons. Limited. By placing a purchase, jewellery order, or custom order with Stacey Whale, you will be deemed to have read, understood, and agree to these terms and conditions. By proceeding with any purchase, jewellery order, custom order, by paying a deposit, or providing full payment, you agree to abide by these Terms and Conditions.
 

If you have any concerns about any aspect of these Terms and Conditions, please discuss and resolve them with us before making any purchase or payment. Your continued use of the Stacey Whale website, sales and services constitutes your acceptance of these Terms and Conditions.

TERMS & CONDITIONS

Terms and Conditions for the Supply of Goods through the Stacey Whale Online Shop (staceywhale.com), the Stacey Whale Physical Shop (1381 Moutere Highway, Upper Moutere, 7173, New Zealand) or via email (stacey@staceywhale.com) and (craig@staceywhale.com). These Terms and Conditions shall apply to all contracts entered into by Stacey Whale ("Stacey Whale," "we," "our," or "us"). By placing your order with us, you are accepting these Terms and Conditions. If you do not accept these Terms and Conditions in full, please refrain from accessing the contents of this website and cease using it immediately.
 

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service" or "Terms & Conditions"), including any additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including, but not limited to, browsers, vendors, customers, merchants, and content contributors.
 

Please read these Terms of Service and Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any of its services. Terms and Conditions in this document will automatically be binding. Your continued use of the Stacey Whale website, sales and services constitutes your acceptance of these Terms and Conditions.

Our online store is hosted on Wix.com, which provides us with the online e-commerce platform, Stripe, allowing us to sell our products and services to you.
 

SITE ACCESS AND CHANGES

Our website changes regularly, and access to this site is permitted on a temporary basis. We aim to update our site regularly and may change the content, including product details and pricing, without notice. If the need arises, we may suspend access to our site or close it indefinitely. Any material on our site may be out of date at any given time, and we are under no obligation to update such material. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms and comply with them.


CONTRACT

Jewellery Purchases and Orders
Please read the following terms and conditions carefully before making a jewellery purchase from Stacey Whale. By proceeding with your purchase or jewellery order, you acknowledge and accept the following:
 

Final Sale:
The majority of our jewellery on offer is made to order. Items purchased, whether through online, in-store, or email transactions, are considered final and non-refundable. We encourage you to thoroughly review your selection and feel free to ask us any questions to clarify and confirm any queries before co
mpleting the purchase.
 

For jewellery orders and custom orders we do not offer refunds, returns or exchanges. jewellery orders and custom orders are final and are non-refundable. Custom orders, include, but are not limited to, jewellery made for you to your specifications and rings made to your ring size.


We no longer offer bespoke commissions.
 

Returns, Exchanges, and Store Credit:
Stacey Whale reserves the right to accept or refuse any return, exchange, or issuance of a store credit.

We do not accept returns or exchanges for reasons such as 'simply changing your mind' or 'not satisfied.'

In the event that a return is granted, a 15% restocking fee will apply.
Due to hygene reasons we do not accept returns on earrings.
Returns, Exchanges and Store Credits can not be exchanged for cash.

Eligibility for Return, Exchange or Store Credit:

To be eligible for a return, exchange or store credit, any jewellery item must meet the following criteria:
a. The item must be in its original condition, unworn, and free from any signs of wear or damage.
b. The original packaging and any accompanying documents, such as certificates of authenticity, must be included and undamaged.

c. We require photographic evidence of the returned jewellery before shipping.

If you need further assistance or have any questions regarding a return process, please do not hesitate to contact us.
 

Return Process:
To initiate a return, please contact us within 7 days of receiving the item to begin the process. You can contact us at stacey@staceywhale.com. We will guide you through the necessary steps and provide you with the appropriate return shipping instructions.
 

Exchange or Store Credit:
Once we receive the returned item and verify its eligibility, you will be eligible for either an exchange or store credit, depending on the nature of the return. If a return is accepted, a shop credit or voucher will be issued with a 1 year valid date from the date the jewellery was returned, and a 15% restocking fee will be deducted. Exchanges and Store Credits can not be refunded or exchanged for cash. The returned item must be received within 7
days from the date of dispatch and insured by the sender.

Returns, Exchanges, and Store Credits are subject to the same Terms and Conditions outlined in this document.

Inspection Upon Receipt: Upon receiving your order, please inspect the item/s carefully to ensure they meet your expectations. If you believe there is a manufacturing defect or any issues with your purchase, notify us immediately for further assistance.
 

Shipping Costs:
Customers are responsible for the return shipping and insurance costs unless the return is due to an error on our part or a defective product. In such cases, we will provide you with a prepaid return shipping envelope.

 

Damage During Transit:

If the jewellery item arrives damaged due to shipping, please contact us immediately with photographic evidence of the damage. We will work with you to resolve the issue and arrange for a replacement or repair if applicable.
 

By proceeding with your purchase, jewellery order, or custom order you agree to the terms and conditions outlined in this document.

No contract will exist between you and us unless Stacey Whale has accepted your order with a confirmation email, and full payment or the deposit is taken from your credit/debit card, via internet banking, or paid for in cash. Our acce
ptance of your order brings into existence a legally binding contract between us, in line with these Terms and Conditions. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts.
 

Stacey Whale reserves the right not to accept or fulfill your order in various situations. These include instances where we are unable to obtain authorisation for payment, if shipping restrictions apply to a particular item, if the item ordered does not meet our quality control standards and is withdrawn, out of stock, or if there is an error in pricing, content, or availability of materials. Additionally, we may refuse to process and accept a transaction for any reason, or refuse service to anyone at any time at our sole discretion. We will not be liable for any indirect or consequential loss, damage, or expenses arising from not accepting your order. Our liability is limited to refunding the amount paid for the goods in question.
 

PAYMENT

By making a purchase on this site or in-store, you confirm that the credit/debit card used belongs to you, or you have explicit authorisation from the card's owner to use it. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the payment card issuer declines the transaction, we will not be liable for any delay or non-delivery. Payment can also be made via internet banking; in such cases, a bank account will be provided.

In-store debit card transactions will incur a 2% surcharge, and credit card transactions will incur a 3.5% surcharge.

All credit/debit card transactions on this site are processed using Stripe.

The prices payable for ordered goods are as set out on our website in NZD (New Zealand Dollars). All prices are inclusive of NZ GST. Delivery charges will be clearly displayed when selected and included in the total cost or confirmed by email.

 

ORDER CANCELLATION

Jewellery orders and custom orders are final and cannot be cancelled, refunded, exchanged or a store credit issued.

No refunds will be made for deposits on design services. This means that if the customer made a deposit for any design work to be undertaken, and later decides to cancel it, they will not be eligible for a refund of the deposit amount. Custom orders often require the seller to invest time, effort, and resources in the design and production process, so deposits for such orders are non-refundable.
 

DEFECTIVE AND DAMAGED ITEMS

Upon receipt of your parcel, it is essential to immediately open it and check for any signs of tampering or damage. If you notice any external damage or tampering, please open the parcel in the presence of the courier and take photos before, during, and after opening. By doing so, you acknowledge that failing to follow this procedure may limit our ability to make a claim against the courier or our insurers if the goods are missing or damaged during delivery. Therefore, if you fail to adhere to this process, you agree to take sole responsibility for any loss or damage, and you waive, release, and indemnify us from any related claims to the fullest extent permitted by applicable law.
 

In the event that you receive a defective, damaged, or incorrect item, please contact us within 2 working days. We will promptly assist you in resolving the issue by providing a replacement for the faulty item once it has been returned to us by post. We will provide the return address in writing after you have contacted us about the fault.
 

PROMOTIONAL SAMPLES

Product samples lent to you by Stacey Whale for promotional material, editorial use, photography or any other reason will be charged for in full if not returned in perfect condition. Unless otherwise agreed in writing by us, samples must be returned to us within 7 working days from the day of receipt.
 

INTELLECTUAL PROPERTY

The entire content of this website, including all jewellery designs, photographs, logo, copyright, trademarks, text and other intellectual property rights it contains, including the use of the name Stacey Whale, Stacey Whale Jewellery or Whale & Sons. Limited is the sole property of Stacey Whale.

 

You may not reproduce in whole or in part, copy or save, any of the contents or material on this website including, but not limited to, jewellery designs, images, videos, concepts, ideas, text, trademarks and you are hereby notified that any copying, or distribution is strictly prohibited.

 

You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this website nor may you use any such content in connection with any business or commercial enterprise. By using this service, you agree that you will not attempt to undermine the integrity of this website.

All intellectual property on this site, including without limit, the text, graphics and copyright works is owned by Stacey Whale. All of our jewellery is designed by us, is unique and belongs to us. You cannot reproduce our designs, or have a jeweller (other than us) reproduce them for you. Intellectal property remains the property of Stacey Whale for all jewellery purchases and custom designs.
 

STONE REMOVING AND SETTING

Great care, caution, and professional craftsmanship will be applied when handling clients' stones and during the stone setting process. However, Stacey Whale is not liable for any rare occurrences of stone damage, such as chipping, scratching, breaking, or cracking, that may happen during stone setting or when removing stones from clients' jewellery.
 

MANUFACTURING GUARANTEE
In the unlikely event of a workmanship defect, Stacey Whale will provide free repair/s for the item within 12
months from the date of purchase. Once returned, the item will be assessed, and if found to be faulty, it will be repaired free of charge. Please note that jewellery will be repaired and not refunded for workmanship defects. However, please be aware that items displaying damage due to fair wear and tear or accidental damage will not be accepted as faulty.
 

For any repairs needed beyond the 12-month guarantee period, Stacey Whale offers a full repair service for a fee based on the required work. To report a manufacturing fault or arrange a repair, please contact us directly, and we will guide you on the next steps to take.
 

It's important to follow the jewellery care instructions, as failure to do so will invalidate the guarantee. Additionally, the guarantee will not apply if the item shows signs of abuse or has been tampered with.


JEWELLERY CARE INSTRUCTIONS

llusion Collection:

  1. Keep the jewellery dry at all times. Avoid submerging it in any liquid, including water.

  2. Refrain from contact with alcohol-based products such as perfumes, hairspray, and creams.

  3. Do not immerse the jewellery in freshwater, sea water, or place it under running water.

  4. Remove the jewellery when showering, doing dishes, cleaning, gardening, or swimming.

  5. Store the jewellery away from direct sunlight and separately from other pieces to prevent scratches. Place it back in your jewellery box when not being worn.

Avoid using any type of jewellery cleaner. Instead, clean the precious metal with a new silver or gold polishing cloth and gently wipe the sapphire lens with a new, soft lint-free cloth.

Pearl Jewellery:

As with all pearls, to preserve the beauty of the gem, we recommend the following:

  1. As a rule, put pearls on last when dressing and first off when undressing. Pearls can be affected by hairspray, perfume, make-up and chemicals in general. Take special care not to expose pearls to household chemical and acidic based foods.

  2. Remove pearl jewellery when washing hands, showering, doing dishes, cleaning, gardening, swimming and playing sport etc. Even if you are really careful with your pearl jewellery, your own body oils are slightly acidic and can damage the surface of pearls over time.

  3. Avoid leaving your pearls in intense sunlight for prolonged periods.

  4. Pearls are softer than other gems and so proper care is important. It is best to store your pearl jewellery separately to avoid scratching the surface against harder gems and jewellery.

  5. Wear your jewellery carefully and avoid pearls rubbing against abrasive fabrics and objects.

  6. Occasionally clean your pearl jewellery very gently with a soft cloth and mild soapy water, rinse in fresh water then dry with a new dry soft cloth.
     

Other Jewellery Care:

  1. Do not submerge or clean your jewellery with any liquid jewellery cleaner.

  2. To clean, soak the jewellery in hot water with mild dishwashing liquid and gently agitate the water. Use a small, soft paint brush to gently brush the surface and any crevices.

  3. Lastly, gently rub the jewellery with a silver or gold polishing cloth.

  4. Remove jewellery when showering, doing dishes, cleaning, gardening, swimming and playing sport.

  5. If you have any questions or need specific instructions, please contact us directly.

  6. Remember, last on - first off. This prevents discolouration caused by perfume, hairspray, or chemicals, etc.

 

DELIVERY

NZ packages are delivered by NZ Post Couriers. The price of postage is calculated based on the value, size, and weight of the package, as well as whether the delivery address is an urban or rural address. Postage will be added to the price.

CUSTOMER'S JEWELLERY

Stacey Whale is not liable for any loss of customer's jewellery in the unlikely event of theft, damage, or rare occurrences during storage, transit, remodelling, assessment, or any other purpose.
 

PRIVACY POLICY
Your personal information provided during the purchase and order process will be handled in accordance with our Privacy Policy. Please review the policy to understand how we collect,
use your data.

Whale and Sons. Limited and entities controlled by it are subject to the Privacy Act 1983.

a) Collection of Personal Information.
We collect personal information (including your full name, address and contact details) so that we may administer our relationship with you, provide you with products and services you request, as well as information about Stacey Whale products and services. Where it is necessary to do so, we also collect information on individual
s such as company directors and officers (where the company is our client), as well as client’s agents and persons dealing with us on a “one off” basis. If you provide us with incomplete or inaccurate information, we may not be able to provide you with the products or services you are seeking.

b) Access to Your Information.

You are entitled to see and have corrected any information we hold about you, any transaction entered into by you with Stacey Whale and Whale and Sons. Limited.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms & Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.


AGREEMENT

erms and Conditions set out the entire agreement between you and Stacey Whale in respect of the sale, purchase, order, service, and use of goods, both online, via email, and in-store. They supersede any previous agreement or understanding in relation to the subject matter hereof. No variation of these Terms and Conditions is binding on us.
